Transient Mooring Licence Rules and Regulations

I agree to abide by the following Rules and Regulations of the Port of Orillia. Failure to comply may result in the immediate termination of this Agreement, removal of the Vessel from the Marina at the Owner's risk and expense, and forfeiture of any fees paid.

General Rules

  1. Check-out time is 11:00 a.m. daily.
  2. The marina docks are for registered guests only. The docks are not public property and unauthorized persons may be removed.
  3. Guests of registered boaters must leave the docks by 11:00 p.m., unless they are staying overnight aboard the Vessel. Marina staff or security may require guests to leave the docks at any time.
  4. Access gates must remain closed at all times. Do not prop open or leave gates unattended.
  5. Swimming is prohibited anywhere within the Marina.
  6. Children must wear properly fitted life jackets and be accompanied by an adult while on docks or around the Marina.
  7. Pets are welcome but must remain leashed and under control at all times in accordance with applicable municipal by-laws.

Noise and Conduct

  1. The Port of Orillia is intended to be enjoyed by all users. Excessive, offensive or disruptive behavior is prohibited.
  2. A quiet period begins at 11:00 p.m. During this time, noise must be reduced to approximately 60 dB, or such level as directed by Marina staff. The Marina reserves the right to require any person to reduce noise at any time.
  3. Excessive daytime noise is also prohibited. Sound levels exceeding approximately 100 dB are not permitted.
  4. During special event weekends where entertainment is provided by the Port of Orillia, boaters must reduce or turn off their own music to allow all guests to enjoy the scheduled entertainment.

Environmental Protection

  1. No person shall discharge sewage, fuel, oil, chemicals, garbage or other contaminants into the water.
  2. Bilge pumps shall not be operated while in the Marina except in an emergency.
  3. Oil changes, hazardous waste disposal and similar maintenance activities are prohibited within the Marina.
  4. All users shall comply with the Port of Orillia Clean Marina Policy and all applicable federal, provincial and municipal environmental legislation.
  5. Garbage must be disposed of in designated receptacles. Garbage shall not be left on docks or aboard vessels where it may attract wildlife. Owners are responsible for any costs associated with wildlife damage resulting from improper waste storage.

Fire Safety and Cooking

  1. Smoking is prohibited on all docks.
  2. Barbecues, charcoal grills, propane grills, cooking appliances and open flames are not permitted on the docks. Cooking is permitted only aboard properly equipped vessels.
  3. Generators may not be operated within the Marina unless expressly authorized in writing by Marina management.

Dock Safety

  1. Chairs, tables, bicycles, scooters, coolers, supplies, accessories and other personal property must not obstruct docks or walkways.
  2. Owners shall not construct lockers, storage boxes or other structures on Marina property without written approval.
  3. Fishing from Marina docks is prohibited, as fishing lines create hazards for vessel operations.
  4. Bicycles, scooters and similar devices must be walked while on Marina boardwalks and docks.
  5. Closed-toe footwear is strongly recommended while on Marina docks.
  6. Owners are responsible for properly connecting and disconnecting shore power. Damage to electrical pedestals, plugs or Marina equipment caused by improper use shall be the responsibility of the Owner.

Vessel Maintenance

  1. Vessel repairs or maintenance are permitted only with prior written approval of the Harbour Master and only to the extent necessary to safely move the Vessel to an appropriate repair facility.
  2. Commercial repair, detailing, renovation or sales activities may only occur with written permission from the Marina.

Marina Operations

  1. The Owner shall move the Vessel when requested by Marina staff for operational, maintenance or emergency purposes.
  2. If a Vessel is unattended and must be moved for safety or operational reasons, the Marina may relocate the Vessel at the Owner's expense and risk.
  3. The Marina reserves the right to assign, relocate or change mooring locations when operationally necessary.

Liability

  1. The Marina shall have a lien against the Vessel, its appurtenances and contents for unpaid fees, damages or other amounts owing.
  2. Use of Marina facilities is entirely at the Owner's risk. The Port of Orillia, its Council, employees, officers and agents shall not be liable for loss of or damage to the Vessel, its equipment, contents or personal property, nor for injury to the Owner, crew or guests, except where liability cannot be excluded by law.
  3. The Owner agrees to indemnify and hold harmless the Port of Orillia, its Council, employees and agents from all claims arising from the Owner's use of Marina facilities.

Insurance

  1. The Owner shall maintain marine liability insurance with limits of not less than $2,000,000 CAD per occurrence throughout the term of this Agreement.
  2. Proof of insurance shall be provided upon request.
  3. Failure to maintain insurance constitutes a material breach of this Agreement and may result in suspension or termination of moorage privileges.
  4. The Owner acknowledges that the Port of Orillia does not insure the Vessel or its contents.

Default and Termination

  1. This Agreement may be terminated by the Marina upon breach of these Rules and Regulations or the Agreement.
  2. The Marina may remove the Vessel from its berth without notice where necessary for safety, security or enforcement of these Rules.
  3. The Marina's waiver of any breach shall not constitute a continuing waiver.
  4. This Agreement may also terminate upon:
  • destruction of Marina facilities by fire, storm or force majeure;
  • bona fide sale of the Vessel;
  • expiration or termination of this Agreement.

Communications

By completing this reservation, the Owner agrees to receive communications from the Port of Orillia, including reservation confirmations, marina updates, event information, special offers, and promotional emails.

The Owner may withdraw their consent and unsubscribe from promotional emails at any time by using the unsubscribe link included in our emails or by contacting the Port of Orillia directly. Unsubscribing from promotional emails will not affect the Port's ability to send transactional or operational communications related to reservations, bookings, safety, billing, or other marina services.

Electronic Agreement

This Agreement executed electronically shall have the same force and effect as an original signed document.

Governing Law

This Agreement shall be governed by the laws of the Province of Ontario and the applicable laws of Canada. Any proceeding arising from this Agreement shall be brought exclusively before the courts of Ontario having jurisdiction in the City of Orillia.

Cancellation Policy

Standard Cancellation

Reservations cancelled at least 48 hours before the scheduled arrival date will receive a credit to the Licensee's Port of Orillia account.

No cash refunds will be issued.

Reservations cancelled less than 48 hours prior to arrival are not eligible for either a refund or account credit.
